A man wrongly arrested for murder in a case of mistaken identity sparked by a tip to the television show “America’s Most Wanted” is suing the show, the Los Angeles Police Department and the Federal Bureau of Investigation.

Robin John Delgado was arrested by Los Angeles police and FBI agents on Feb. 4 in Silver Lake, according to a suit filed Monday in Los Angeles Superior Court.

Authorities reportedly believed Delgado was Armando Garcia, a former Miami policeman wanted for stealing cocaine and attempting to kill a government witness. He has been on the FBI’s 10 most-wanted fugitive list since 1989.

Delgado, who apparently looks like Garcia, was arrested following a viewer’s tip to the television show, but he was soon released. The suit seeks unspecified damages for loss of earnings, medical and other expenses. Spokeswomen for the FBI and LAPD declined comment due to the pending litigation. Representatives of “America’s Most Wanted” could not be reached.
