House Color Suit
Thank you for the article on the U.S. District Court’s ruling on the Karagozian Case (“Judges Allow Lawsuit Over House Color,” May 8).
However, it is equally or more important to note that the court’s ruling was not only that the Karagozians could maintain their action for damages, but also that they could maintain an action for a declaratory judgment of the unconstitutionality of the purported power of the city of Laguna Beach to control a resident’s right to choose his or her house color, on its face and as applied--i.e., both the purported power itself and the city’s manner of exercise of it.
