Attorneys for Laura Troiani have appealed Superior Court Judge Gilbert Nares’ decision to bar testimony by a New Jersey sociologist from being presented to the jury in Troiani’s murder trial.

Troiani and five Camp Pendleton Marines are charged with murder and conspiracy to commit murder in the 1984 slaying of Troiani’s husband, Staff Sgt. Carlo Troiani.

Judge Nares refused to allow testimony by Lionel Tiger, a professor at Rutgers University and an author, that Laura Troiani was not capable of being the mastermind in her husband’s murder. Tiger testified outside the presence of the jury Wednesday.

An aide in defense attorney Geraldine Russell’s office said Friday that a writ was filed Thursday with the Fourth District Court of Appeal seeking to overrule Nares’ decision excluding the sociologist’s testimony.
