Tustin : Bank Says Its Name Misused by RV Firms
Sunwest Bank has not gone into the RV business. And the Tustin-based bank would like its customers to know it.
On Tuesday, the bank sued a dozen defendants for allegedly selling time-share interests in recreational vehicles by using Sunwest Bank’s name.
“Specifically, the defendants stated or implied they are agents . . . or representatives” of Sunwest or told people that the bank endorsed the RV time-share program, the lawsuit alleged.
Defendants named in the lawsuit filed in Orange County Superior Court include Spence Enterprises Inc.; RV Share; Cams Inc. and Monarch Travel. None of the defendants could be reached for comment Tuesday.
The bank, which has called itself Sunwest for the past seven years, said it discovered two weeks ago that the defendants have been using Sunwest Bank’s name for the last year. In the suit, Sunwest sought a restraining order and unspecified damages for alleged false advertising and infringement of its names.
