Student files lawsuit after knee injury in gym class

A Marine View Middle School student has filed a claim against the Ocean View School District for injuries he says he sustained while performing a long jump Feb. 28 after experiencing knee pain.

Jacob Schopp-Kirkup is requesting that $2,098.26 in medical fees that were not covered by health insurance be paid by the district. Jacob’s knee cap was shifted three inches higher than normal.

The claim said physical education instructor Dave Sanford told Jacob to “do your best” at performing the long jump, after Jacob said his knees were bothering him.

Jacob contended he ran as fast as he could, then pushed off the plank to make the jump; he then heard something in his knee pop and landed face-first in the sand pit. After diagnosing the fracture, Jacob’s doctor moved his knee cap back into place and screwed the bones back together on March 4, the claim said.

The district board of trustees will make a decision on the claim Tuesday.
