More deliberations, no rape-trial verdict

Jurors in the retrial of a gang-rape case completed their second full

day of deliberations Tuesday with more questions but no verdict.

The eight-man, four-woman jury is deciding the fate of Rancho

Cucamonga residents Kyle Nachreiner and Keith Spann and Greg Haidl,

the son of a former sheriff’s official. Prosecutors say the three

gang-raped an unconscious 16-year-old girl when they were 17 and

sexually assaulted her with various objects during a 2002 party at

Haidl’s Corona del Mar home.

Defense attorneys argued that the girl, referred to in court as

Jane Doe, was a promiscuous, hard-drinking teen who willingly

participated in the encounter.

The defendants videotaped the alleged assault and that tape was a

key piece of evidence in the trial.

Jurors on Tuesday asked to have portions of testimony by three

doctors read back to them. That testimony came from two neurologists

-- one who testified for the prosecution and one for the defense --

and a colorectal specialist who testified for defense attorneys.

The jurors later chose not to have the transcripts read. They

broke for the day around 4:30 p.m. and are scheduled to resume

deliberations this morning.

So far, jurors have deliberated for roughly 15 hours. Jurors in

the first trial of the case remained deadlocked after 20 hours of

deliberations and the judge declared a mistrial.

The three defendants face up to 23 years in prison if convicted.
