Taking a look at each side of the Newport Beach fence debate

Assuming that the encroachment does not involve property needed by
the city for any reason, the city should offer to sell the property
to the homeowner at market price. If the homeowner does not wish to
purchase it, the city should enforce its rights and take the property
back. For example, it should insist that the homeowner remove fences,
etc.

I feel like the fences should be moved at homeowners’ expense, and
they should be moved to their property line.
As a runner, I have often jogged through Irvine Terrace Park and
wondered why there is a padlock on the cityside to the land that is
city property when homeowners have unlocked gates to access the same
area.
Now, I realize they would need to have an unlocked gate to
retrieve a ball that went over the fence -- but so would people who
are playing in the park.
The public also needs to retrieve balls that go over the fence.
So, I think the gates should be unlocked for public access to the
city property.
