Courts to Decide Liability in Swap Meet Counterfeits: A federal appellate court ruling in a lawsuit brought by a Los Angeles-based Latino recording company said swap meets could be held liable for the sale of counterfeit goods at their establishments. Fonavisa Inc. sued Cherry Auction Inc., operators of a Fresno swap meet that allegedly sold counterfeit Fonavisa audiocassettes. The U.S. 9th Circuit Court of Appeals in San Francisco ruled that swap meet owners could be held liable if they were in a position to supervise counterfeit sales and if they profited from the sales. A lower court had dismissed the suit, but the appellate court reversed that action and sent the case back to Fresno for trial.
