WEST HOLLYWOOD : 2nd Challenge of Ban on Gay Marriages Planned
An attorney who is challenging a California law that prohibits same-sex marriages will file another lawsuit.
Paul S. Marchand, a lawyer representing a West Hollywood gay couple who want to legally marry, filed a lawsuit last week in state court against James H. Dempsey, incorrectly identifying Dempsey as the county clerk who refused to issue Marchand’s clients a marriage license in February.
In the new lawsuit, Marchand said that he will correctly identify the county clerk as Bea Valdez.
“I feel I have some egg on my face,†Marchand said. “But one would think that because Dempsey was the clerk of the Superior Court, he’d also be the county clerk. It was a mistake anyone could make.â€
