Prosecutors declined to file sexual assault charges against San Francisco 49er owner Eddie DeBartolo Jr., but the woman who accused DeBartolo asked her attorneys to request that the state attorney general’s office conduct an independent investigation. She also is considering a civil lawsuit.
“I don’t intend to let this go away,” said Gina Baross, 24.
San Mateo County District Attorney Jim Fox said he would not prosecute because he didn’t think he could get a conviction, although there was evidence that could support the allegation, such as the woman’s torn pantyhose and underwear, and some bruises.
DeBartolo refused comment.
