Court Lets Judge’s Impeachment Stand
WASHINGTON — The U.S. Court of Appeals on Tuesday refused to tamper with the Senate’s removal of U.S. District Judge Walter L. Nixon from the bench, saying his impeachment conviction is not a matter for the courts.
Nixon, of Mississippi, asked for his job back on grounds that he was deprived of a full hearing because the Senate delegated evidence-gathering to a committee.
The former judge was first convicted in federal court of two counts of perjury and was sentenced to five years in prison. He refused to resign and continued to draw a salary.
He was impeached and convicted in 1989.
