Damage Award Against B of A Thrown Out

A judge has thrown out a $1-million punitive damage award granted by a jury to a Richmond, Calif., computer programmer who sued the Bank of America for software piracy.

Gulab Tinmahan sued the bank in November 1983, charging that it illegally used software he developed.

A San Francisco Superior Court jury last December awarded him $1.25 million in general damages and $1 million in punitive damages.

Superior Court Judge FRank Shaw overturned the punitive damage award and granted the bank a new trial.
